Winning A Personal Injury Case After Falling On Ice

Law Blog

If you just fell down when walking across a business parking lot due to their negligence in removing ice for their customers, proving the incident did not occur because of clumsiness will be necessary should you decide to press charges. Many decide to file a suit against a business if they become injured due to a reason that could have been avoided with simple upkeep. Here are some steps you can take in an attempt to prove the business was at fault for the injuries you had sustained.

Get Medical Assistance Immediately

Right after you fall down, it is imperative to call for medical assistance. Failing to get checked over by a physician after a fall could cause you to lose the chance of monetary compensation if you need to head to a doctor later on. Wait in the area where you had fallen for an ambulance to arrive.

It is best to keep all appointments regarding your injury, retain all documentation given to you by your physician, and follow instructions regarding prescriptions as recommended. Failing to keep on top of your medical condition will make it less likely you will be awarded compensation as it will appear you are not injured from the incident.

Take Photographs Of The Parking Area

Grab your cell phone and take as many photos as possible of the spot where you had fallen. Do this from the position where you are lying or sitting and be sure to get as much of your body into one of the shots as possible to show the angles of your legs or torso. This can be helpful in proving you did not lie or sit down on your own in an attempt to gain money from a false fall. Take close-ups of the ice to show how much there is present as well as the thickness to prove it may have been sitting in this area for a while.

Gather Evidence To Help Prove Your Case

If there were others in the parking area at the time of your fall, make sure to get their names and phone numbers so they can be used as witnesses if you decide to push the incident into a courtroom situation. Taking photographs of other vehicles in the lot may also prove to be beneficial as your attorney may be able to help you track down the motorists to see if they had seen anything important to help prove your case.

If there are outside cameras in the lot, find out if the business has footage available for you to view to help prove you were not at fault for your fall. This should be done through your attorney. This way the business will not be tipped off about your intent to press charges, possibly making them erase evidence to help your case.
