2 Things You Should Know About Going Through A Divorce

Law Blog

There are many people who are thinking about divorcing their spouse. In fact, it is likely that almost half of the people who get married will at some point experience a divorce. Because it is so common, many people think that they know what to expect with a divorce, but in fact, there are a lot of things that you might not know about divorce until you have been through it. Here are some things you should know.

1. It is Really Hard To Keep It Professional

When you start the legal process for a divorce your lawyer will advise you to keep it professional, not personal. Rather than look at the divorce as a way to punish the other person, you should look at it like the dissolving of a business agreement. Simply go through the assets and the custody of the children and view it like a business transaction. If you are able to do this, then your divorce will go so much smoother and you will be more pleased with the end result. The problem is that very few people are unable to do it. Instead, the majority of divorces get personal and they get messy. But you should still try to make it easier.

2. You Will Go Through Mediation

As you start the process you may have already determined that you don't want to do mediation. You may want to go straight to court and let a judge decide the agreement. The problem is that because so many couples divorce, the courts are bombarded with people needing to see a judge. This is why it is required that everyone go through mediation before they can even see a judge. You simply cannot even appear in court unless you have first tried to do mediation.

Additionally, you will save so much time and money if you can resolve it with mediation, so your attorney will recommend taking some sort of settlement. Listen to your divorce lawyer. You may think that your case is different and unique, and although it is unique to you, the attorney sees this everyday. They know when a good deal is presented and they know when you should fight harder. If your attorney advises you to settle and compromise, do what you can to comply. It is unlikely that even if you go to court you will get a different outcome. The judge will probably end up splitting it 50/50 anyways.

By knowing these things you can be more prepared for your divorce.
